Purpose and Protection

The Modern Insight™ follows all federal and Colorado privacy laws, including the Health Insurance Portability and Accountability Act (HIPAA). Client information is treated with strict confidentiality. Electronic records, telehealth sessions, and client communications are encrypted and stored securely.

All client health information is maintained in Sessions Health, a HIPAA-compliant electronic health record (EHR) and telehealth platform. The Modern Insight PLLC has a formal Business Associate Agreement (BAA) with Sessions Health, ensuring encryption, audit logging, and security consistent with federal HIPAA and Colorado law.

Billing and payment processing occur only through Sessions Health. QuickBooks Online is used strictly for accounting and tax reporting; no Protected Health Information (PHI) or client identifiers are stored there.

Records are retained for a minimum of seven years after the last client contact (or, for minors, seven years after the client reaches age 18) in accordance with 4 CCR 734-1 Rule 13 and C.R.S. § 12-245-224. Records are securely deleted or destroyed when retention periods expire. If The Modern Insight terminates use of Sessions Health, records will be securely exported or destroyed consistent with federal and state law.

Information Collected

The Modern Insight may collect limited personal and health information for clinical, scheduling, or billing purposes. This may include your name, contact information, appointment history, and clinical documentation. Any information provided through the contact form or secure email is protected under HIPAA and Colorado law.

How Information Is Used

Information is used only to provide psychotherapy services, maintain records, coordinate care, and manage billing. Personal information is never sold or shared with third parties except as required by law or with your written consent.

Client Rights

Clients have the right to:
• Request access to their records. Colorado law permits a summary in place of full notes if full release may be clinically harmful (C.R.S. § 25-1-801).
• Ask for corrections or amendments to information.
• Receive information about how their data is used or disclosed.
• Request restrictions on use or disclosure of their PHI (where legally feasible).
• Receive confidential communications by a preferred method.
• File a privacy complaint without fear of retaliation with either The Modern Insight, DORA, or the U.S. Department of Health & Human Services.

Requests for access or correction must be submitted in writing to the clinician.

Limits of Confidentiality

Confidentiality is protected by law, though there are exceptions. Information may be disclosed without consent if required by law, including:
• Risk of serious harm to self or others.
• Suspected child, elder, or dependent-adult abuse or neglect.
• Court order or legal subpoena.
These exceptions align with Colorado statute (C.R.S. § 12-245-220 and C.R.S. § 19-3-304) and the professional ethics for Licensed Marriage and Family Therapists.

Telehealth and Electronic Communication

Telehealth sessions are conducted through the Sessions Health HIPAA-compliant platform. Clients must be physically located in Colorado at the time of session.

Email communication and forms are transmitted via secure, encrypted services. The Modern Insight does not use text messaging for clinical communication, scheduling, or any care-related matters. All clinical communication occurs through the secure Sessions Health portal. Although reasonable safeguards are in place, electronic communication carries inherent privacy risks. Clients are encouraged to use only secure, approved channels.

Website and Cookies

This website does not sell data or use cookies for targeted advertising. Anonymous analytics may be collected to improve site performance. No Protected Health Information is collected through this website.

Informed Consent and Therapeutic Relationship

Contact through this website or form submission does not create a therapeutic relationship. Services are provided only after completion of the intake process and signed informed consent documents, including the Mandatory Disclosure Statement and Practice Policies & Communication Agreement.

You agree to receive informational messages (appointment reminders, account notifications, etc.) from The Modern Insight PLLC. Message frequency varies. Message and data rates may apply. For help, reply HELP or email connect@themoderninsight.com. You can opt out at any time by replying STOP.

Mobile SMS Messaging Privacy Policy
Information collected may include your name, phone number, and email address. This information is used only for administrative purposes such as billing, customer service, appointment reminders, and account notifications. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Messaging frequency may vary. All policies comply with CTIA guidelines 5.2.1. You may request deletion of your information at any time via email or mail.

Important Note from The Modern Insight PLLC
The Modern Insight PLLC does not use SMS text messaging for therapy communication, scheduling, or clinical matters. Text messaging is reserved solely for administrative or business correspondence. Clients are asked to use the secure Sessions Health portal for all care-related communication.

Mandatory Disclosure Statement and Colorado Law Compliance

In accordance with the Colorado Mental Health Practice Act (C.R.S. § 12-245-214 and Rule 5 of 4 CCR 734-1), each client receives a Mandatory Disclosure Statement detailing the therapist’s credentials, fee structure, methods of therapy, client rights, and confidentiality protections. This statement also identifies The Modern Insight’s regulatory oversight by the Colorado Department of Regulatory Agencies (DORA).

Clients are entitled to information about methods of therapy, duration, fees, and may seek a second opinion or terminate therapy at any time. Sexual intimacy is never appropriate in the therapeutic relationship and should be reported to the licensing board.

Breach Notification and Policy Updates

In the event of a breach of unsecured PHI, clients will be notified promptly in accordance with HIPAA and Colorado law. This policy is reviewed annually and updated as needed to reflect changes in law or vendor agreements. Material changes will be communicated via email or the client portal.
